ADR Consulting Services
When is ADR appropriate?
Mediation and arbitration are commonly used tools to resolve disputes outside of the courtroom. ADR may be the most appropriate method of resolution when a dispute arises and it is in the best interest of the associated parties.
Why ADR?
Litigation is expensive, time consuming, a drain on company resources, and largely unpredictable. ADR provides various processes to resolve a dispute short of litigation.
When a dispute arises and it is in the best interest of the associated parties ,ADR may be the most appropriate method of resolution.

Before entering into any arbitration or mediation, it is critical that each party be thoroughly prepared to present their case or have a negotiation strategy. In the process, it can be easy to overlook important aspects of an issue or to become so closely entwined with the situation that it becomes difficult to discern the quality of an argument or what is the most effective strategy. In these circumstances, bringing in an experienced jurist with experience in mediation and arbitration to help understand and position one’s best arguments could make the difference.

Arbitration

 


Independent mediators and arbitrators that consider arguments and evidence from both sides to decide on a final and binding decision.

Arbitration – A voluntary process that can be binding or non-binding in which the parties collectively retain an arbitrator(s) to adjudicate or referee the dispute and act as a judge and jury between them. Arbitration resembles a lawsuit in some ways, but it’s done far less formally, and at a far lower cost to both parties. Both parties agree to be bound by the decision of the arbitrator.”

Mediation

 


Instead of dictating a solution to the dispute, the mediator suggests various proposals to help the two parties reach a mutually agreeable solution.

Mediation – A voluntary, non-binding process where a neutral third party (a mediator retained by both parties) facilitates negotiations between the parties with the goal being to reach a mutually acceptable resolution.”
